1. Event Information

The Cinco de Mayo Festival (“Event”) is an outdoor festival organized by El Mirador En El Rio, LLC in collaboration with Next Level Entertainment. The Event is scheduled for Saturday, May 2, 2026, at the Peoria Riverfront, 110 NE Water St, Peoria, IL 61602. The Event runs from 12:00 PM to 11:30 PM.

2. Ticket Purchases & Refund Policy

All ticket sales are final. No refunds, exchanges, or transfers will be issued under any circumstances, including but not limited to inclement weather, personal scheduling conflicts, or event modifications. The Event is a “Rain or Shine” event and will proceed regardless of weather conditions.

Tickets are non-transferable unless explicitly authorized by El Mirador En El Rio, LLC. Tickets must be redeemed for festival bracelets at El Mirador En El Rio prior to or on the day of the Event. Lost or stolen bracelets will not be replaced.

3. Promotional Codes & Discounts

Promotional codes issued in connection with ticket purchases are subject to the following conditions: (a) each promotional code is valid for one-time use only per sale; (b) promotional codes are non-transferable and have no cash value; (c) promotional codes expire on the date specified at the time of issuance; (d) El Mirador En El Rio, LLC reserves the right to modify or discontinue any promotional offer at any time without prior notice.

4. Assumption of Risk

By attending the Event, you voluntarily assume all risks associated with attendance, including but not limited to: personal injury, property damage or loss, exposure to weather conditions, exposure to communicable diseases, and any other risks inherent to outdoor public events. El Mirador En El Rio, LLC, Next Level Entertainment, their officers, directors, employees, agents, and affiliates shall not be liable for any injury, loss, or damage of any kind sustained by any attendee.

5. Code of Conduct

All attendees are expected to conduct themselves in a respectful and lawful manner. El Mirador En El Rio, LLC reserves the right to refuse entry or remove any individual from the Event premises without refund for any reason, including but not limited to: disorderly conduct, intoxication, possession of prohibited items, harassment, or any behavior deemed unsafe or disruptive by Event staff or security personnel. This is a family-friendly event.

6. Vendor & Sponsor Agreements

Vendors and sponsors participating in the Event are subject to separate agreements and must comply with all applicable local, state, and federal regulations, including health and safety codes, business licensing requirements, and insurance obligations. El Mirador En El Rio, LLC is not responsible for the products, services, or conduct of third-party vendors or sponsors. Vendor and sponsorship fees are non-refundable.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of El Mirador En El Rio, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent.

8. Photography & Media Release

By attending the Event, you consent to being photographed, filmed, or recorded. You grant El Mirador En El Rio, LLC and its affiliates an irrevocable, royalty-free license to use your likeness, image, and voice in any media for promotional, advertising, or any other lawful purpose without compensation or further consent.

9. Limitation of Liability

To the fullest extent permitted by law, El Mirador En El Rio, LLC and its affiliates, partners, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website, attendance at the Event, or any products or services purchased in connection with the Event. This limitation applies regardless of the theory of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless El Mirador En El Rio, LLC, Next Level Entertainment, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your attendance at the Event, your use of this website, or your violation of these Terms & Conditions.

11. Event Modifications

El Mirador En El Rio, LLC reserves the right to modify the Event schedule, lineup, activities, vendors, or any other aspect of the Event at any time without prior notice. Such modifications shall not entitle any ticket holder to a refund.

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Peoria County, Illinois.

13. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
